1. Acceptance of Terms
By accessing or using ShowingUnlock at showingunlock.com (the “Service”), you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Service. ShowingUnlock is operated under the brand name ShowingUnlock.
2. Description of Service
ShowingUnlock connects Texas homebuyers with licensed real estate agents for on-demand, flat-fee property showings, and maintains a directory of discount brokers. The Service is available to residents of Texas and is provided for the purpose of facilitating single property showings.
3. Buyer Showings
To request a showing, a buyer submits a property listing link and address, completes identity verification, acknowledges the Information About Brokerage Services (IABS) disclosure, and pays a flat showing fee plus service charge. ShowingUnlock broadcasts the request to available licensed agents in the area. The first agent to claim the request meets the buyer at the property at the agreed time.
ShowingUnlock is not a real estate brokerage and does not represent either party in a transaction. The agent who shows the property is not representing the buyer as a client unless a separate written representation agreement is established.
4. Payments & Refunds
The total amount is held as an authorization at checkout. Upon completion of the showing, the showing fee is released to the agent (or sponsoring broker per their configured split) and the service charge is retained by ShowingUnlock. If a buyer cancels, the following refund tiers apply based on the time between cancellation and the scheduled showing:
- 100% refund when cancelled more than 24 hours before the scheduled showing.
- 50% refund when cancelled between 2 and 24 hours before the scheduled showing.
- No refund when cancelled less than 2 hours before the scheduled showing.
If a showing remains unclaimed after broadcast, the buyer may cancel for a full refund with no time penalty.
5. Identity Verification
Buyers and agents must complete identity verification. ShowingUnlock reserves the right to decline or suspend service to anyone who cannot be verified or who provides false information.
6. Agent & Broker Obligations
Agents must hold a current, active Texas real estate license and perform all showing activity under the supervision of their sponsoring broker in accordance with TREC rules and TRELA. Agents must obtain prior written authorization from their sponsoring broker to perform gig showings through ShowingUnlock and to receive direct payouts where applicable. Brokers are responsible for any split percentages and consent they configure in the broker portal.
7. Non-Representation (SB 1968)
Each showing is conducted under a written Non-Representation Agreement consistent with Texas SB 1968, and the buyer acknowledges the IABS disclosure. ShowingUnlock does not collect or store property access or lockbox codes; access to the property is coordinated between the buyer and the showing agent.
8. Acceptable Use
You agree not to use the Service for any unlawful purpose, to misrepresent your identity, to harass other users, to share property access codes through the messaging feature, or to attempt to circumvent payment or verification requirements.
9. Intellectual Property
All content, branding, and software on showingunlock.com are the property of ShowingUnlock or its licensors and may not be copied or reproduced without permission.
10. Disclaimers & Limitation of Liability
The Service is provided “as is” without warranties of any kind. ShowingUnlock is not liable for the conduct of agents, brokers, or buyers, for the condition of any property shown, or for any indirect, incidental, or consequential damages arising from use of the Service. ShowingUnlock’s total liability is limited to the amount paid for the showing at issue.
11. Indemnification
You agree to indemnify and hold ShowingUnlock harmless from claims arising out of your use of the Service or your violation of these Terms or applicable law.
12. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in Texas.
13. Changes to These Terms
ShowingUnlock may update these Terms from time to time. The current version will always be posted at showingunlock.com/terms with a revised effective date.
